UK-based European Patent Attorneys Able to Represent Parties at the UPC

By Joseph Lenthall, Partner

The Unified Patent Court (UPC) Administrative Committee has confirmed here that many UK-based European patent attorneys will be able to represent parties at the UPC. With a team boasting experienced patent attorneys and litigators, Haseltine Lake Kempner LLP will therefore be ideally placed to represent parties in UPC litigation.

Parties can be represented by European patent attorneys who have “appropriate qualifications”. Following Brexit, there was some uncertainty as to whether UK-based European patent attorneys would retain the right to represent parties at the UPC. However, the Rules relating to representation by European patent attorneys has confirmed that certain UK qualifications will be considered an appropriate qualification.

The news brings greater choice for parties when it comes to UPC representation and for parties to tap into the skills of UK-based European patent attorneys. In particular, the UPC team at Haseltine Lake Kempner LLP draws from their expertise and experience of patent litigation and EPO oppositions, as well as a deep understanding of the technology from patent drafting and prosecution work.
